A child is considered “migratory” if the child or youth made a qualifying move in the last three years as a migratory agricultural worker or with, or to join, a parent or spouse who is a migratory agricultural worker.
A “migratory agricultural worker” is an individual who made a qualifying move within the last three years and after doing so, engaged soon after in new temporary or seasonal employment in agriculture, dairy, lumber or fishing industries or actively sought new employment and has history of moves where worker engaged in industries previously mentioned.
A “qualifying move” must include a move from one residence to another residence and across school district boundaries due to economic necessity.
The eligibility period is three years from the date of their last eligible move. Eligibility is established through an interview conducted by a Migrant Education Recruiter who visits both home and employment locations where migrant workers are employed. The law states that migrant education services are a priority for those students who have made a qualifying move within the previous one-year period and who are failing, or are most at risk of failing to meet state academic standards, or who have dropped out of school.

Un niño es considerado “migratorio” si el niño o joven hizo una mudanza calificativa en los últimos tres años como un trabajador migratorio agrícola, con o ha unirse con un padre u esposo/a que es un trabajador migratorio agrícola.
El individuo que hizo una mudanza calificativa dentro de los últimos tres años y después de verse movido, poco después empezó un nuevo empleo temporal o estacional en industrias agrícolas, lecherías, la madera o pesquerías, también si busco activamente un nuevo empleo y tiene historia de mudanzas donde el trabajador trabajo en las industrias mencionadas anteriormente es un “trabajador migratorio agrícola”.
Una “mudanza calificativa” debe incluir una mudanza de una residencia a otra residencia, cruzar los límites del distrito escolar y la mudanza es por razones económicas.
El periodo de la elegibilidad del niño o joven es por tres años, empieza de la fecha del último movimiento calificativo. La elegibilidad es establecida por medio de una entrevista conducida por un reclutador del programa migrante quien hace visitas a los hogares y lugares de empleo. La ley establece que los servicios del programa migrante son prioridad para los estudiantes que han hecho una mudanza calificativa dentro del periodo de un año previo y quienes están fallando están en mayor riesgo de no cumplir con los estándares académicos del estado o quienes han abandonado los estudios.
